1. Who These Terms Are Between

Swingers Golf Studio operates three indoor golf simulator bays at The Sports Hub, Level 1, 26 Main Drive, Bokarina QLD 4575 (the "Facility"). The Facility is unstaffed and accessible to Members 24 hours a day, 7 days a week, using an access and booking system managed through Alba Play.

By completing a membership registration, making a booking, or entering the Facility, you agree to be bound by this Agreement. If you do not agree to these terms, you must not register as a Member or enter the Facility.

2. Definitions

• Facility: the Swingers Golf Studio premises at The Sports Hub referred to above, including all simulator bays, equipment, fixtures and common areas.

• Member: a person who has completed registration and holds a current, paid membership with Swingers (includes Introductory Membership Pack).

• Guest: a person accompanying a Member into the Facility who is not themselves a Member.

• Booking Platform: Alba Play, or any replacement booking, membership and access-management platform Swingers uses from time to time.

• Membership Plan: the specific tier a Member subscribes to (currently offered in 1-hour, 3-hour and 5-hour per week individual tiers, and the Introductory Membership (5 x 1 hour sessions), as described on the Swingers website.

• Fee Schedule: the current pricing for Membership Plans and Introductory Pack Offer published on swingersgolfstudio.com.au, updated from time to time.

• Minimum Term: the minimum commitment period (if any) that applies to a Membership Plan, as set out in the Fee Schedule at the time you join.

3. Membership & Facility Access

3.1 Age requirement

Members must be 18 years of age or older. Swingers does not offer a standalone junior or under-18 membership. Anyone under 18 may only be in the Facility as a supervised Guest of a paying adult Member - see clause 5 (Guests).

3.2 Unstaffed facility

The Facility operates without on-site staff for the great majority of its opening hours. There is no supervision and no staff member on hand to assist in real time. You use the Facility entirely at your own risk, on the basis set out in clause 10 (Assumption of Risk, Waiver & Indemnity).

3.3 Access Credentials

• Access is granted through your unique Access Credential, issued via the Booking Platform (Alba Play) once your membership is active and your session is booked.

• Your Access Credential is personal to you. It must not be shared, lent or used by anyone else, including family members who are not separately registered as Members or booked Guests.

• Sharing your Access Credential, or letting anyone into the Facility outside a valid, paid booking, is a serious breach of this Agreement and may result in immediate suspension or termination of your membership.

3.4 Leaving the Facility secure

You must ensure all doors are closed and secured behind you on entry and exit, and must not admit anyone who is not part of a valid booking, regardless of how well you know them.

4. Bookings & Use of the Facility

• Sessions are booked in advance through the Booking Platform. Tee times are released periodically (typically fortnightly). Membership Plans include a set entitlement of simulator time per week (or 5 x 1hr sessions in the Introductory Membership); using more than your entitlement will incur additional charges at the Additional Hours rate set out in the Fee Schedule. While last-minute bookings are permitted if space is available, advanced booking is highly encouraged to guarantee preferred times.

• You must arrive and vacate the bay within your booked window. Overstaying may affect the next Member's booking and may incur additional charges.

• Repeated no-shows, late cancellations, or booking patterns that unreasonably restrict other Members' access may result in a warning, a temporary suspension of booking privileges, or termination of membership.

• Swingers may set aside bay time for maintenance, coaching, functions or competitions with reasonable notice to Members.

5. Guests

• Guests are welcome but must be added to your booking through the Alba Play Booking Platform (and any applicable guest fee paid) before they enter the Facility.

• You are responsible for your Guests' conduct, safety and any damage they cause while in the Facility, as if it were your own.

• Guests under 18 are welcome, but must be accompanied and directly supervised at all times by the paying adult Member who booked the session.

6. Fees, Billing & Membership Term

6.1 Fees

Membership fees are charged in accordance with the Membership Plan you select and the Fee Schedule current at the time of charging. Fees are billed automatically through the Booking Platform on a monthly or yearly basis.

6.2 Minimum term

Membership Plans carry a minimum term of 3 months from your sign-up date (the "Minimum Term"). You agree to pay the fees for the full Minimum Term even if you stop using the Facility during that period, except where you cancel in accordance with clause 7.

6.3 Missed payments

If a scheduled payment fails, we will attempt to process it again and may suspend your Access Credential until payment is received. Membership fees continue to accrue while a payment is outstanding; a failed payment does not by itself end your membership or your obligation to pay.

6.4 Fee changes

We may vary the Fee Schedule from time to time. Where a change affects your current Membership Plan, we will give you at least 30 days' notice by email or through the Booking Platform before it takes effect.

7. Pausing & Cancelling Membership

7.1 Pausing

If your Membership Plan allows pausing, you may request a pause by contacting us. Pause conditions (minimum/maximum duration, medical exceptions) will be assessed on a case by case basis.

7.2 Cancelling

• You may cancel your membership by giving at least 2 weeks' written notice (email is fine) to hello@swingersgolfstudio.com.au

• Cancellation takes effect once both the Minimum Term has been served and your 2 weeks' notice has elapsed, whichever is later; cancelling before the Minimum Term is complete means you remain liable for the fees for the balance of the term, unless clause 11 (Force Majeure) or a consumer guarantee under the Australian Consumer Law applies.

• We may suspend or terminate your membership, with or without notice depending on severity, for a serious or repeated breach of this Agreement, including sharing Access Credentials, bringing unbooked Guests, damaging the Facility, or non-payment.

8. Facility Conduct

8.1 General conduct

• Use all equipment safely and as intended, and follow any signage or instructions displayed in the Facility.

• Be considerate of other Members and neighbouring businesses - keep noise reasonable and stick to your booked bay and time.

• Please leave your bay clean and tidy: return equipment to its place, take your rubbish with you, and report any faults to hello@swingersgolfstudio.com.au rather than leaving them for the next Member.

8.2 Alcohol & drugs

No alcohol is served at, or may be brought onto, the premises. You must not attend the Facility under the influence of alcohol or illicit drugs. Breach of this clause may result in immediate termination without refund. 

8.3 Smoking & vaping

Smoking and vaping are not permitted anywhere inside the Facility.

9. Equipment and Technology

Simulators: Members have access to 3 premium bays featuring GSPro software and ProTee VX launch monitors.

Clubs: Members must bring their own golf clubs.

10. Damage to the Facility & Equipment/Technology

You are responsible for the cost of repairing or replacing any damage caused by you or your Guests to the Facility, simulator bays, screens, launch monitors, projectors, fixtures or fittings etc, beyond fair wear and tear. Swingers may recover these costs from you directly, including any resulting loss of income while the affected bay is out of use.

11. Assumption of Risk, Waiver & Indemnity

11.1 Acknowledgement of risk

Golf, even indoors, carries an inherent risk of injury from swinging clubs, struck balls, and moving equipment. By becoming a Member, you acknowledge that:

• the Facility is unstaffed for all of its operating hours (24/7)  and no supervision is provided;

• you use the Facility, and allow your Guests to use it, entirely at your own risk;

• Swingers does not provide personal accident or injury insurance for Members or Guests, and you are encouraged to arrange your own cover if you want it;

• you are responsible for ensuring any Guests you bring understand and accept these risks.

11.2 Release

To the maximum extent permitted by law, you release and discharge Swingers, its officers, employees, contractors and agents from any claim arising from personal injury, death, or property loss or damage suffered by you or your Guests while at the Facility, except to the extent caused by Swingers' gross negligence or a failure of a guarantee that cannot be excluded under the Australian Consumer Law.

11.3 Indemnity

You agree to indemnify Swingers against any claim, loss, damage or cost arising from your conduct, your Guests' conduct, or your breach of this Agreement, except to the extent caused by Swingers' negligence.

12. Force Majeure

Swingers is not liable for any failure to provide access to the Facility caused by events reasonably outside our control - including natural disasters, power or internet outages, government restrictions, public health orders, or vandalism affecting the Facility. We will make reasonable efforts to restore access and to communicate with affected Members, but we do not guarantee refunds or credits for lost access in these circumstances beyond what the Australian Consumer Law requires.

13. Safety & Emergencies

• Familiarise yourself with the emergency exits and any evacuation information displayed in The Sports Hub and Facility before you begin your session.

• In a genuine emergency, call 000 first and activate the duress alarm located on the wall shared by Sim 1 and Sim 2. 

• As the Facility is unstaffed for most hours, you are responsible for your own safety and for managing any incident until help arrives.

14. CCTV & Privacy

The Facility is monitored by CCTV (excluding any private areas such as bathrooms) for safety, security and incident investigation purposes. We handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, available on our website. By using the Facility, you consent to footage being used for these purposes.

15. Your Consumer Guarantees

Nothing in this Agreement excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where our services fail to meet a consumer guarantee, you are entitled to the remedies available under that law.

16. Changes to These Terms

We may update this Agreement from time to time. We will notify you of material changes by email or through the Booking Platform. Continuing to use the Facility after a change takes effect means you accept the updated terms.

17. Governing Law

This Agreement is governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland.
